You need to agree to the EULA in order to run the server. Go to eula.txt for more info.

 

This is the error I keep getting but I have set it true and it was to true by default does anyone know how to fix this?

You were a little vague in your post, setting the value to true should allow the server to run yes, if you want it to be true by default for all new servers, you need to go to the Game directory and find the eula.txt in there and set that to true, if you don't know what I mean I can explain further, I just don't know if I'm answering the right question/not sure what you're asking.
